Welcome to labelshabel.com, operated by Label Shabel LLP ("Label Shabel", "we" or "us"). "You" or "User" means any natural or legal person using or purchasing from this website (the "Website"), whether or not registered. By using the Website you agree to these Terms of Service, together with our Privacy Policy, Shipping & Delivery Policy and Returns & Cancellation Policy, which are incorporated herein and override any contradictory terms. We reserve the right to make changes to the Website and these terms at any time; it is your responsibility to review them periodically, and your continued use of the Website after changes are posted constitutes acceptance. If you are a minor (under 18 years), you shall not register as a User or transact on the Website.

This Website uses cookies to enable the shopping cart and checkout and to monitor browsing preferences (see our Privacy Policy). While we endeavour to keep all information up to date and correct, we make no representations or warranties of any kind about the completeness, accuracy, reliability, suitability or availability of the Website or its information, products or services; any reliance you place on such information is at your own discretion. We have made every effort to display product colours as accurately as possible, but actual colours depend on your monitor and we cannot guarantee their accuracy. All products carry Label Shabel branding in the form of our logo or website name, and Label Shabel reserves the right to carry its name branding on all products manufactured and/or sold by us.

Acceptance of orders

All orders are subject to our acceptance or rejection in whole or in part, and we reserve the right at any time after receipt of your order to accept or decline it for any reason. Every order is created through a unique personalisation process - please review your personalisation details carefully before submitting.

User conduct & communications

You agree not to provide text or content for your personalised products that is unlawful, threatening, abusive, vulgar, harassing, defamatory, obscene or otherwise objectionable. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. When you use the Website or send us emails or other communications, you consent to communicate with us through electronic records, and to receive communications from us electronically or by other modes as required. We may indefinitely suspend, terminate or block access to your membership for breach of these terms. Reproduction or copying of any material or content on this Website is strictly prohibited without our express prior written consent.

Prices & taxes

Prices listed are current but may change without notice, and we reserve the right to correct errors or misprints. All prices are in Indian Rupees (INR) and are inclusive of GST and applicable taxes, which Label Shabel collects and remits as required by law. In the event of any inaccuracy in content or pricing we may refuse or cancel an order (whether or not confirmed and/or paid); payment for such orders will be refunded. We may amend the price of any item or withdraw an item at any time. Images may be for illustration purposes and may not depict the actual product.

Payment terms

All purchases must be prepaid using the methods offered at checkout (credit card, debit card, UPI, net banking and other online methods). You agree and confirm that the payment details you provide are correct, accurate and lawfully yours; the liability for fraudulent use of a payment instrument rests with you and the onus to prove otherwise is exclusively yours. Your payment information is not shared with third parties except as required for fraud verification, by law, regulation or court order. We reserve the right to recover the cost of goods, collection charges and legal fees from persons using the Website fraudulently, and to initiate legal proceedings for fraudulent or unlawful acts.

Shipping

All orders are custom-made and shipped in accordance with our Shipping & Delivery Policy published on this Website. We deliver through reputed Indian courier providers, or India Post EMS where courier service is unavailable. The dispatch of goods constitutes fulfilment of our contract; we are not liable for costs, courier errors or expenses on account of late deliveries. If non-delivery occurs because of an error by you (wrong name, address or other information), any extra cost of redelivery shall be payable by you.

Consumer agreement

As a Label Shabel customer, you agree to hold Label Shabel and its principals, subsidiaries and partners harmless for any issues or property damage which may result from the use of Label Shabel products. Label Shabel cannot make any express or implied guarantees through the use of its products, and does not warrant that the quality of any products, services or information will meet your expectations or that any errors will be corrected. You agree to bear all risks and responsibilities for the use and results of products purchased from Label Shabel.

Indemnification

You agree to indemnify and hold Label Shabel and its partners, employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses arising out of your use of this Website or any products purchased from Label Shabel.

Termination of use

Label Shabel may, in its sole discretion, terminate your account or your use of the Website at any time. You remain personally liable for any orders placed or charges incurred prior to termination. Label Shabel reserves the right to change, suspend or discontinue all or any aspects of the Website without prior notice.

Disclaimers & limitation of liability

Use of the Website is at your sole risk. The Website and all products sold are provided on an "AS IS" basis. We do not warrant that the Website will be uninterrupted or error-free. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LABEL SHABEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Under no circumstances shall Label Shabel be liable for any direct, indirect, incidental, special or consequential damages resulting from your use of, or inability to use, the Website or any products purchased, in any action whether in contract, tort or otherwise, even if advised of the possibility of such damages. This limitation is a fundamental part of the basis of our bargain with you. No part of the Website may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring") without our express prior written consent. Nothing in these terms limits your rights under applicable consumer protection law.

Severance & no waiver

If any provision of these terms is held invalid, illegal or unenforceable, it shall be severed and the remaining provisions shall survive in full force. Failure to enforce any right or provision, including with respect to a breach, is not a waiver of that right or of the right to act on subsequent breaches.

Governing law & grievances

These terms and all claims between you and Label Shabel are governed by the laws of India, and the courts at New Delhi, India shall have exclusive jurisdiction. We aim to acknowledge and resolve grievances within the timelines prescribed under applicable law, including the Consumer Protection (E-Commerce) Rules, 2020.
